1. WHAT INFORMATION DO WE COLLECT?

 

Personal information you disclose to us

In Short: We collect personal information that you provide to us such as name, address, contact information, passwords, and security data.

We collect personal information that you voluntarily provide to us, automatically as you navigate through the Site (refer to the section below titled, “Information automatically collected”), or which we collect from third parties that are associated with UpstreamSquad.

We collect the personal information which you provide to us when you complete the user registration, subscribe to a newsletter, email list, submit feedback, enter a contest, fill out a survey, or send us a communication.

When you register to our Site or use it as a Collaborator, and/or register to any of our affiliate, influencer, or similar programs, we ask you to provide certain personal information and during your interactions with our Site, you may choose to provide us with additional information at various times (see examples listed below for details).  The personal information that we collect depends on the context of your interactions with us and the Services, the choices you make, and the features you use. Here are some examples of types of information that we might collect:

  • Publicly Available Personal Information. This is the information that is shown to the public and may be visible to registered users of UpstreamSquad: profile image, about me, display name, spoken languages, contact details: location, website, business email, phone number (if made public), social media links and messenger IDs.  

  • Personal Information Provided by You That is NOT Available to the Public. This is the information that is collected by us that is not shown to the public: My SSA Login Details: email, password; My SSA User Details & Preferences - Private: First Name, Middle Name, Last Name, Birthday; My Billing Details:  First Name, Middle Name, Last Name, Account Type, Organization, Billing Address, City, ZIP/Postal Code, State/County, Country, My Email Preferences, My Operating System(s), My Favorite DAW(s), How did you hear about SSA. We also collect information about your communications with UpstreamSquad as well as communication with other users of UpstreamSquad. 

  • Personal Information Provided by You. We collect data collected from surveys; communications with our Site and with other users of our Site; and similar data.

  • Credentials. We collect, encrypt, and store passwords and similar security information used for authentication and account access. Encrypted passwords are completely private and we do not have access to them. 

  • All personal information that you provide to us must be true, complete, accurate, and you must notify us of any changes to such personal information.

 

Information automatically collected

In Short: Some information — such as IP address and/or browser and device characteristics — is collected automatically when you visit our Services.

We automatically collect certain information when you visit, use or navigate the Services. This information does not reveal your specific identity (like your name or contact information) but may include device and usage information, such as your IP address, browser and device characteristics, operating system, language preferences, referring URLs, device name, country, location, information about how and when you use our Services and other technical information. This information is primarily needed to offer you a better experience on our Site, to maintain the security and operation of our Site, and for internal analytics, marketing, and reporting purposes.

Like many businesses, we also collect information through cookies and similar technologies. See Section 5 for more information on cookies.

Online Identifiers. We collect your device's geolocation; cookie identifiers, and other identifiers such as the ones used for analytics and marketing; tools and protocols, such as IP (Internet Protocol) addresses; and other similar data.

 

Information collected from other sources

In Short: We may collect limited data from public databases, marketing partners, and other outside sources.

We may obtain information about you from other commercially available sources such as data aggregators and public databases, (who provide us data to supplement the information we collect about you, in accordance with applicable laws) joint marketing partners, and other third parties. Examples of the information we receive from other sources include: social media profile information; marketing leads and search results and links, including paid listings (such as sponsored links); fraud warnings from service providers for our fraud prevention and risk assessment efforts.

 

2. WHY WE COLLECT YOUR PERSONAL INFORMATION AND HOW DO WE USE IT?

In Short: We process your information, in order to fulfill our contract with you, to comply with our legal obligations, and for other legitimate business purposes.

We use personal information collected via our Services for a variety of business purposes described below. We process your personal information for these purposes in reliance on our legitimate business interests, in order to enter into or perform a contract with you, with your consent, and/or for compliance with our legal obligations. We indicate the specific processing grounds we rely on next to each purpose listed below.

We use the information we collect or receive:

  • To facilitate account creation and logon process. We use your email and password to facilitate account creation and logon process for the performance of the contract. We also ask you to fill in a unique Display Name upon account creation.

  • To send you direct marketing and promotional communications. We and/or our third-party marketing partners may use your personal information to send you direct marketing communications about our products, services, and related services or promotions from UpstreamSquad that may be of interest to you. This may be via email, message on our Site, or through targeted online advertisements. You will only receive marketing emails if this is in accordance with your marketing preferences. You can opt-out of our marketing emails at any time by going to the edit profile section of the Site or clicking the unsubscribe button at the bottom of the marketing emails. We take steps to limit direct marketing to a reasonable and proportionate level and to send you communications which we believe may be of interest or relevance to you, based on the information you have provided.

  • To send administrative information to you. We may use your personal information to send you product, service, and new feature information and/or information about changes to our terms, conditions, security updates, and policies. This will mainly be through email.

  • Deliver targeted advertising to you. We may use your information to develop and display content and advertising (and work with third parties who do so) tailored to your interests and/or location and to measure its effectiveness.

  • Administer prize draws and competitions. We may use your information to administer prize draws and competitions when you elect to participate in competitions.

  • Request Feedback. We may use your information to request feedback and to contact you about your use of our Services.

  • To protect our Services. We may use your information as part of our efforts to keep our Services safe and secure (for example, for fraud monitoring and prevention).

  • To enable user-to-user communications. If both users consent, we may use your information in order to enable user-to-user communications through our platform’s commenting system and other forms of communication on our platform.

  • To enforce our terms & conditions and policies for Business Purposes, Legal Reasons, and Contractual.

  • To respond to legal requests and prevent harm. If we receive a subpoena or other legal request, we may need to inspect the data we hold to determine how to respond.

  • To manage user accounts. We may use your information for the purposes of managing our platform and keeping it in working order.
                             

  • To deliver services to the user. We may use your information to provide you with the requested service including but not limited to our website content.

  • To respond to user inquiries/offer support to users. We may use your information to respond to your inquiries and solve any potential issues you might have with the use of our Services.

  • For other Business Purposes. We may use your information for other Business Purposes, such as data analysis, identifying usage trends, determining the effectiveness of our promotional campaigns, and to evaluate and improve our Services, marketing, and your experience. We may use and store this information in aggregated and anonymous form so that it is not associated with individual end-users and does not include personal information. We will not use identifiable personal information without your consent.

3. WILL YOUR INFORMATION BE SHARED WITH ANYONE?

In Short: We only share information with your consent, to comply with laws, to provide you with services, to protect your rights, or to fulfill business obligations. 

We may process or share data based on the following legal bases:

  • Consent: We may process your data if you have given us specific consent to use your personal information for a specific purpose.

  • Legitimate Interests: We may process your data when it is reasonably necessary to achieve our legitimate business interests.

  • Performance of a Contract: Where we have entered into a contract with you, we may process your personal information to fulfill the terms of our contract.

  • Legal Obligations: We may disclose your information where we are legally required to do so in order to comply with applicable law, governmental requests, a judicial proceeding, court order, or legal process, such as in response to a court order or a subpoena (including in response to public authorities to meet national security or law enforcement requirements).

  • Intellectual Property Infringement: We will disclose personal information to rights holders in relation to an allegation of intellectual property infringement or any other infringement.

 

  • Vital Interests: We may disclose your information where we believe it is necessary to investigate, prevent, or take action regarding potential violations of our policies, suspected fraud, situations involving potential threats to the safety of any person, defend our rights, and illegal activities, or as evidence in litigation in which we are involved.

More specifically, we may need to process your data or share your personal information in the following situations:

  • Vendors, Consultants, and Other Third-Party Service Providers. We may share your data with third-party vendors, service providers, contractors, or agents who perform services for us or on our behalf and require access to such information to do that work.

We share your information for the purpose of operating the Site, opening and operating your account, to fulfill obligations imposed on us by applicable laws and regulations, and prevent fraud and illegal activities, and provide ancillary services for the purpose of operating the Site. Examples include data analysis, email delivery, hosting services, customer service, and marketing efforts.

We may allow selected third parties to use tracking technology on the Services, which will enable them to collect data about how you interact with the Services over time. This information may be used to, among other things, analyze and track data, determine the popularity of certain content, better understand online activity, and to secure the Site and protect it against fraud, unauthorized transactions (such as money laundering), claims, or other liabilities; Unless described in this Policy, we do not share, sell, rent or trade any of your information with third parties for their promotional purposes. We have contracts in place with our data processors. This means that they cannot do anything with your personal information unless we have instructed them to do it. They will not share your personal information with any organization apart from us. They will hold it securely and retain it for the period we instruct.

  • Business Transfers. We may share or transfer your information in connection with, or during negotiations of, any merger, sale of company assets, financing, or acquisition of all or a portion of our business to another company.

  • Business Partners. We may share your information with our business partners to offer you certain products, services, or promotions.

  • Other Users. When you share personal information (for example, by posting comments, contributions, or other content to the Services) or otherwise interact with public areas of the Services, such personal information may be viewed by all users and may be publicly distributed outside the Services in perpetuity.

We combine your personal information with information we collect automatically or obtain from other companies and use it to improve and personalize our services, content and advertising and/or to prevent fraud.

4. WHO WILL YOUR INFORMATION BE SHARED WITH?

In Short: This section explains the very limited circumstances in which we share user information with third parties.

We do not sell or rent your personal information to third parties for their marketing purposes without your explicit consent. Our contracts with these service providers do not permit the use of your information for their own (marketing) purposes.

Please note, your public information and additional information regarding your activity (refer to the WHAT INFORMATION DO WE COLLECT section for a list of publicly available information) is visible to all Users of the Site. When you publish your information and/or share your data with other UpstreamSquad Users, you do so at your own risk. While UpstreamSquad strives to protect your privacy and our Terms of Service require our Users not to use the data shared with them, UpstreamSquad cannot ensure that all Users will do so.

 

5. DO WE USE COOKIES AND OTHER TRACKING TECHNOLOGIES?

In Short: We may use cookies and other tracking technologies to collect and store your information.

We may use cookies and similar tracking technologies (like web beacons and pixels) to access or store information. Specific information about how we use such technologies and how you can refuse certain cookies is set out in our Cookie Policy. For more general information on cookies, see http://www.allaboutcookies.org

You can set your browser to refuse cookies, but doing so may limit system performance and may even cause certain features of the Platform to malfunction or not to work at all.

 

6. WHAT IS OUR STANCE ON THIRD-PARTY SITES?

In Short: We are not responsible for the safety of any information that you share with third-party providers who advertise, but are not affiliated with, our Site.

The Services may contain advertisements from third parties that are not affiliated with us and which may link to other sites, online services, or mobile applications. We cannot guarantee the safety and privacy of data you provide to any of these third parties. Any data collected by third parties is not covered by this privacy policy. We are not responsible for the content or privacy and security practices and policies of any third parties, including other sites, services, or applications that may be linked to or from the Services. You should review the policies of such third parties and contact them directly with any questions you may have.

 

7. ARE YOU PROTECTED BY THIS PRIVACY POLICY WHEN VISITING EXTERNAL LINKS ON UpstreamSquad?

In Short: Any data that you provide to other sites from the external links present on UpstreamSquad are not under the control of our privacy policy. 

Please note that our Site contains links to third party sites and if you link to a third-party site from our Site, any data you provide to that site and any use of that data by the third party are not under the control of UpstreamSquad and are not subject to this Policy. You should consult the privacy policies of each site you visit. This Policy applies solely to personal information collected by our Site. If you upload content, including your personal information, to a social network, and then tag UpstreamSquad, your submission will be subject to that social network's terms of use and privacy policy, even where you post on an official UpstreamSquad page on the social network. We do not have control over these terms of use and privacy policies and have not reviewed their adequacy. You should therefore review these before submitting any personal information.

8. PERSONAL INFORMATION FROM CHILDREN

In Short: You must be 13 years or older to use our Site. 

We do not allow children under the age of 13 to use our website. Children between the ages of 13 and 18 should have a parent or guardian supervise them at all times when using the Site. If we learn we have collected or received personal information from a child under 13, we will delete that personal information. 10. HOW LONG DO WE KEEP YOUR INFORMATION?

In Short: We keep your information for as long as it is necessary and relevant for our operations unless otherwise required by law.

We retain your personal information for as long as it is necessary to provide the Services to you and others and to comply with our legal obligations. If you no longer want us to use your personal information or to provide you with our services, you can erase your personal information by deleting your account in the edit profile section of the Site or contacting us at [email protected]. Please note that if you request the erasure of your personal information we will retain information from deleted accounts which is necessary for our legitimate business interests, to comply with the law, prevent fraud, collect fees, resolve disputes, troubleshoot problems, assist with investigations, or requests by government, a court of law, or law enforcement authorities, enforce the terms of service and take other actions permitted by law. The information we retain will be handled in accordance with this Privacy Policy.

No purpose in this policy will require us to keep your personal information for longer than 2 years past the termination of the user's account.

When we have no ongoing legitimate business need to process your personal information, we will either delete or anonymize it, or, if this is not possible (for example, because your personal information has been stored in backup archives),  we will securely store your personal information and isolate it from any further processing until deletion is possible.

 

11. WHERE DO WE STORE YOUR PERSONAL INFORMATION?

In Short: We store your information on secure servers that are managed by us and our service providers.

We store personal information on secure servers that are managed by us and our service providers. Personal information that we store or transmit is protected by security and access controls, including username and password authentication, and data encryption where appropriate.

Some of the personal information you provide to us will be stored or processed on our behalf by third party suppliers and data processors (payment processors, email service providers, etc.) and may be located in other jurisdictions whose laws may differ from the jurisdiction in which you live.

 

12. HOW DO WE KEEP YOUR INFORMATION SAFE?

In Short: We aim to protect your personal information through a system of organizational and technical security measures.

We have implemented appropriate technical and organizational security measures designed to protect the security of any personal information we process. Information a user submits through the platform may not be encrypted. Please also remember that we cannot guarantee that the internet itself is 100% secure. Although we will do our best to protect your personal information, the transmission of personal information to and from our Services is at your own risk. You should only access the Services within a secure environment.

As a user or guardian of a user that is 13 to 18 years old, you are responsible for maintaining the confidentiality of your account and password. If you use our platform, you are responsible for restricting access to your computer or connected devices, and you agree to accept responsibility for all activities that occur under your account or password. You agree to notify us immediately of any unauthorized use of your account or any other breach of security. We reserve the right to refuse service, terminate accounts, or remove or edit content in our sole discretion.

 

13. WHAT ARE PRIVACY RIGHTS REQUIRED BY UNDER THE GDPR?

In Short: In some regions, such as the European Economic Area, you have rights that allow you greater access to and control over your personal information. You may review, change, or terminate your account at any time.

In some regions (like the European Economic Area or EEA), you have certain rights under applicable data protection laws. 

These may include the right:

(i) to request access and obtain a copy of your personal information that was collected and about how and on what basis that personal information is processed. You can also request information on how data will be collected, processed, and stored, and for what purposes before the data is collected.

(ii) to request rectification (have incorrect or incomplete data corrected)

(iii.) to request the erasure of your personal information in limited circumstances where (a) you believe that it is no longer necessary for us to hold your personal information; (b) we are processing your personal information on the basis of legitimate interests and you object to such processing, and we cannot demonstrate an overriding legitimate ground for the processing; (c) where you have provided your personal information to us with your consent and you wish to withdraw your consent and there is no other ground under which we can process your personal information; and (d) where you believe the personal information we hold about you is being unlawfully processed by us.

(iv) to restrict the processing of your personal information where: (a) the accuracy of the personal information is contested; (b) the processing is unlawful but you object to the erasure of the personal information; (c) we no longer require the personal information for the purposes for which it was collected, but it is required for the establishment, exercise or defense of a legal claim or (d) you have objected to us processing your personal information based on our legitimate interests and we are considering your objection.

(v) to object to processing which we have justified on the basis of our legitimate interest

(vi.) to object to and to opt-out of decisions that are based solely on automated processing or profiling that are subject to algorithmic decision making.

(vii.) to ask us for a copy of this data in a structured, machine-readable format and to ask us to share (port) or move this data to another data controller when you have provided your personal information to us with your consent.

(viii.) to obtain a copy of or access to safeguards under which your personal information is transferred outside of the EEA.

In certain circumstances, you may also have the right to object to the processing of your personal information. To make such a request, please use the contact details provided below. We will consider and act upon any request in accordance with applicable data protection laws.

If we are relying on your consent to process your personal information, you have the right to withdraw your consent at any time. Please note however that this will not affect the lawfulness of the processing before its withdrawal. These rights are limited in some situations – for example, we can demonstrate that we have a legal requirement to process your personal information. In some instances, this means that we may retain some data even if you withdraw your consent.

If you are resident in the European Economic Area and you believe we are unlawfully processing your personal information, you also have the right to complain to your local data protection supervisory authority. We will ask you for additional data to confirm your identity and for security purposes, before disclosing data requested to you. We reserve the right to charge a fee where permitted by law. We will decline to process requests that jeopardize the privacy of others, are extremely impractical, or would cause us to take any action that is not permissible under applicable laws. Additionally, as permitted by applicable laws, we will retain where necessary certain personal information for a limited period of time for record-keeping, accounting, and fraud prevention purposes.

14. DATA BREACH

A privacy breach occurs when there is unauthorized access to or collection, use, disclosure, or disposal of personal information. You will be notified about data breaches when UpstreamSquad believes you are likely to be at risk or can incur serious harm. For example, a data breach may be likely to result in serious financial harm or harm to your mental or physical well-being. In the event that UpstreamSquad becomes aware of a security breach which has resulted or may result in unauthorized access, use or disclosure of personal information UpstreamSquad will promptly investigate the matter and notify the applicable Supervisory Authority not later than 72 hours after having become aware of it unless the personal data breach is unlikely to result in a risk to the rights and freedoms of natural persons.

 

15. CONTROLS FOR DO-NOT-TRACK FEATURES

Most web browsers and some mobile operating systems and mobile applications include a Do-Not-Track (“DNT”) feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. No uniform technology standard for recognizing and implementing DNT signals has been finalized. As such, we do not currently respond to DNT browser signals or any other mechanism that automatically communicates your choice not to be tracked online. If a standard for online tracking is adopted that we must follow in the future, we will inform you about that practice in a revised version of this privacy policy.

 

16. DO CALIFORNIA RESIDENTS HAVE SPECIFIC PRIVACY RIGHTS?

In Short: Yes, if you are a resident of California, you are granted specific rights regarding access to your personal information.

California Civil Code Section 1798.83, also known as the “Shine The Light” law, permits our users who are California residents to request and obtain from us, once a year and free of charge, the following information:

  • The categories or specific pieces of personal information that we collect about you.

  • The categories of sources from which personal information is collected.

  • The purposes for collecting, using, or selling that personal information.

  • The categories of third parties with whom we share that personal information.

  • If we disclosed your personal information for a business purpose, the categories of personal information we have disclosed in the prior twelve months.

  • If we sold your personal information, the categories of personal information we have sold in the prior twelve months.

As previously mentioned in the Privacy Policy, we do not sell (as such term is defined in the CCPA) personal information and will not sell it without providing users with a right to opt-out.

All California residents have a right to request that we delete your personal information under certain circumstances and exceptions. You also have a right not to be discriminated against for exercising your rights under the CCPA. To request the removal of such data, please contact us at [email protected], and include the email address associated with your account and a statement that you reside in California. We will make sure the data is not publicly displayed on the Services, but please be aware that the data may not be completely or comprehensively removed from our systems.

We may verify your request using the information associated with your account, including email address. Government identification may also be required. Users can also designate an authorized agent to exercise these rights on their behalf.

You can review, change, and delete your personal information by logging into the UpstreamSquad Site and visiting the edit profile page.

 

17. DO WE MAKE UPDATES TO THIS POLICY?

In Short: Yes, we will update this policy as necessary to stay compliant with relevant laws.

We may update this privacy policy from time to time in order to make sure it stays up to date with the latest legal requirements and any changes to our privacy management practices. The updated version will be indicated by an updated “Revised” date and the updated version will be effective as soon as it is accessible. If we make material changes to this privacy policy, we may notify you either by prominently posting a notice of such changes or by directly sending you a notification. We encourage you to review this privacy policy frequently to be informed of how we are protecting your information.

 

18. HOW CAN YOU REVIEW, UPDATE, OR DELETE THE DATA WE COLLECT FROM YOU?

We take steps to ensure that the personal information we collect is accurate and up to date, and we provide you with the opportunity to review, update, or delete your information by logging into your account and viewing the edit profile section of the Site. You can terminate your account in the edit profile section of the platform as well or by notifying us at [email protected], and we will delete your account and information from our active databases. However, some information may be retained in our files to prevent fraud, troubleshoot problems, assist with any investigations, enforce our Terms of Use and/or comply with legal requirements.
